Country Vacations not refunding my paid amount of rs. 80, 000/- after cancellation of agreement-reg.

This has reference to the agreement for sale of membership made and
Executed at vizag on 15/07/2018 between country vacations (Cchhl),
Duly represented by sri s. Harinath, line manager and mausumi das
(My-wife), residing at qr. No. 158/a, sector-12, ukkunagaram, vizag.
As per clause no. 31 of the agreement, there shall be a cool off period of 10 days from the date of signing the agreement, wherein the member can discontinue the agreement after paying nominal administrative charge of rs. 3800/- to the company. After deduction of the amount, remaining amount would be refunded to the member within 120 days from the date of invoking of cool off period. For invoking the cool off period, the member shall send a written communication to the country club, central customer care, 4th floor, asian building, begumpet, hyderabad-500016 through registered post or an e-mail.

Vide emails dated 20.07.2018 at 10.04am, the decision to discontinue the agreement was communicated to the above email address from the registered email id. Thereafter several reminder mails as referred above were sent from the registered email id. Every time the following computer generated message was received:

“dear concern, greeting of the day, thank you for reaching customer care country club holidays and hospitality ltd, we will be addressing your concern at the earliest based on the priority of the complaint. Further you can reach us on between 10:30 am-6:30pm monday to saturday”

Many times customer care person was contacted vide above phone number. Most of the time nobody lifted the call. Whenever they lifted the call, the same reply, your case is under process and when it will be finalized, we will call you to give the refund amount. Now a days, if we call to hyderabad customer care office, they are asking us to contact vizag office and vizag office advising us to contact head office at hyderabad.

They are supposed to refund within 120 days, but after one year also they are playing and not in the intention to refund. The reason for our withdrawal of agreement is what verbally they promised at vizag, when we receive the agreement, the conditions were different. It is a big fraud company.

As per the clause no. 31 of agreement an amount of 76, 200/- (Rupees seventy six thousand two hundred only) is required to be refunded to us
After deducting rs. 3800/- from the paid amount of rs. 80, 000/-
However, instead of returning my amount, the company has sent membership cards forcefully to accept the same with their terms and
Conditions, which are not acceptable. Every month i am being forced to pay emi for the above purpose.

Therefore, i request you to do needful so as to enable me to get back my legitimate amount fro the company, m/s country vacations.
