Mr Saji Kumar of Buildwell Builders and Developers showed me Flat No D-121 of Apple Apartments, Mattoor Kalady near Kochi International Airport on 05 Mar 2020 and told me that the flat is for sale for ₹10, 000, 00/- (Rupees Ten Lakhs Only) excluding registration charges to which I agreed to buy the flat. I had deposited an amount of ₹5, 00, 000/- (Rupees Five Lakhs Only) to his IDBI Bank Edapally Branch Account No [protected] on 10 March 2020 and he acknowledged the receipt of the said amount and assured me that I would get possession of the said flat in two months. However, due to the pandemic induced lockdown on 25 Mar 2020, he couldn’t hand over the flat and I cooperated with him since the matter was beyond his control.
I repeatedly followed up with him for more than two years till Apr 2022 and he kept assuring me that he would hand over the flat to me post completion of all the formalities. Despite the fact that the lockdown was fully lifted by Dec 2020, he didn’t make any efforts to hand over the flat to me.
Finally in April 2022, more than two years after I handed over ₹5, 00, 000/- to him, he contacted me to inform me that I needed to pay the remaining amount of ₹5, 00, 000/- (Rupees Five Lakh Only) to complete the deal and he would hand over the flat in two weeks. Since I had already paid half the amount, I promptly deposited the remaining amount of Rs 5, 00, 000/- (Rupees Five Lakh Only) in his account on 12 Apr 2022 and he acknowledged the receipt for the same on 23 Apr 2022.
The receipt for both the instalments of Rs 5, 00, 000/- (Rupees Five Lakh Only) each was acknowledged for Flat No D-121, the flat which was shown to me when the deal was finalised. However, when he finally wanted to hand me the possession, he wanted to hand over Flat No B-113 which I was not iterested in buying it. The deal was finalised for Flat D-121 since that flat was fully inspected by me I was satisfied that it was in a good condition amongst three other flats which had cracks in wall and not in good condition, Flat No B-113 being one of them which Mr Saji Kumar was forcefully trying to sell me. Since I refused to buy the flat which was in bad condition and threatened to take legal action against him for defrauding me, he agreed to refund the amount and asked for one months time in Apr 2022 to which I agreed.
However, post eight months he still hasn’t returned the money. He kept my money for two years, to which I never objected since the circumstances were beyond his control. I didn’t take any legal action against him since he requested me not to do so and that he would return the money. Now when it is time to refund money he says that he doesn’t have money since he used my money to get his daughter admitted in a medical college in Chennai.
Despite me cooperating with him for close to eight months as per his request, he doesn’t seem to be interested to return my money since he has used my money to meet his personal commitments of getting his daughter admitted to a Medical College in Chennai. I have called him on multiple occasion and he either doesn’t answer my calls or even if he does attend it, he says he will call me back and he never calls back.
I am a central government employee and I was posted in Kochi when I initiated the deal to buy the flat in Mar 2020. However I got transferred out to Gujarat in November 2020 and since then he has stopped responding. I came to Kochi in Apr 2022 to meet him and solve the issue but he said he couldn’t meet me since he was out of town. Despite the fact that I was in Kochi for four days to resolve the issue, he didn’t meet me. I went to his office too on multiple occasions but it was locked. The builder Mr Saji is a fraudster who is unwilling to return the money.
It is therefore requested that legal action be taken against Mr Saji Kumar KP and his company Buildwell Builders and Developers to return my ₹10, 00, 000/- (Rupees Ten Lakhs Only)paid to him alongwith penal charges of last two years. And the company be barred from undertaking future transactions since they are a fraud company.
